1. Acceptance of Terms

By accessing, downloading, installing, or using Nyrexclient ("the Service," "Nyrexclient," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use Nyrexclient.

These Terms constitute a legally binding agreement between you and Nyrexclient. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting on this page.

2. Description of Service

Nyrexclient is a third-party Minecraft client modification (mod) designed for Fabric 1.21+ that provides enhanced gameplay features, performance optimizations, and automation tools. Nyrexclient is not an official Minecraft product and is not affiliated with, endorsed by, or sponsored by Mojang Studios or Microsoft Corporation.

3. Eligibility and Age Requirements

You must be at least 13 years old to use Nyrexclient. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. By using Nyrexclient, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will not use Nyrexclient for any illegal or unauthorized purpose

4. License and Usage Rights

4.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Nyrexclient for personal, non-commercial purposes.

4.2 License Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of Nyrexclient
• Reverse engineer, decompile, or disassemble Nyrexclient
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Share, resell, or redistribute your license or access credentials
• Use Nyrexclient to violate any laws, regulations, or third-party rights
• Use Nyrexclient on servers that prohibit client modifications
• Create derivative works based on Nyrexclient without explicit written permission

5. Subscription and Payment Terms

5.1 Subscription Plans

Nyrexclient offers subscription plans (monthly and lifetime). By purchasing a subscription, you agree to pay the fees associated with your chosen plan.

5.2 Payment

• All fees are processed through secure third-party payment processors
• Fees are charged in advance for the subscription period
• All sales are final unless otherwise stated
• We reserve the right to change pricing with 30 days' notice

5.3 Refund Policy

Refunds are handled on a case-by-case basis. Generally, refunds are not provided for digital products unless required by law or in cases of technical issues preventing use of the Service. Contact our support team for refund requests.

5.4 Subscription Cancellation

Monthly subscriptions can be cancelled at any time. Cancellation will take effect at the end of your current billing period. Lifetime licenses are permanent and do not require renewal.

6. Prohibited Uses

You agree NOT to use Nyrexclient to:

• Violate any applicable laws, regulations, or third-party rights
• Cheat, exploit, or gain unfair advantages in multiplayer games in violation of server rules
• Harass, abuse, or harm other players
• Interfere with or disrupt servers, networks, or services
• Transmit viruses, malware, or other harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Collect or harvest information about other users
• Use automated systems to access the Service (bots, scrapers, etc.)

7. Server Rules and Compliance

You are solely responsible for ensuring that your use of Nyrexclient complies with the rules and terms of service of any Minecraft server you connect to. We do not condone the use of client modifications on servers that prohibit them. Violation of server rules may result in:

• Your account being banned from that server
• Legal action by the server operators
• Termination of your Nyrexclient license (in cases of severe violations)

8. Intellectual Property Rights

Nyrexclient, including all content, features, functionality, code, graphics, logos, and trademarks, is owned by us and protected by international copyright, trademark, and other intellectual property laws. Minecraft is a trademark of Mojang Studios. We are not affiliated with Mojang Studios or Microsoft Corporation.

You acknowledge that you do not acquire any ownership rights by using Nyrexclient. All rights not expressly granted to you are reserved by us.

9. Updates and Modifications

We reserve the right to update, modify, or discontinue any aspect of Nyrexclient at any time, with or without notice. We are not obligated to provide updates, but when updates are provided, you may be required to install them to continue using the Service.

10. Disclaimer of Warranties

NYREXCLIENT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not guarantee that Nyrexclient will be compatible with all versions of Minecraft, all servers, or all systems. Use of Nyrexclient is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Server bans or account suspensions
• Damage to your computer or software
• Any other damages arising from your use or inability to use Nyrexclient

Our total liability for any claims arising from or related to Nyrexclient shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nyrexclient, its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Nyrexclient
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any server rules or terms of service

13. Account Termination

We reserve the right to suspend or terminate your access to Nyrexclient at any time, with or without cause or notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Sharing or reselling your license
• Abuse of the Service or our support systems
• Non-payment of subscription fees

Upon termination, your right to use Nyrexclient will immediately cease, and you must delete all copies of Nyrexclient in your possession.

14. Third-Party Services

Nyrexclient may integrate with or link to third-party services (e.g., Discord, payment processors). We are not responsible for the content, privacy policies, or practices of third-party services. Your interactions with third-party services are subject to their respective terms and policies.

15. Dispute Resolution

Any disputes arising from or related to these Terms or Nyrexclient shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the appropriate courts.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nyrexclient regarding the use of the Service and supersede all prior agreements and understandings.
